Liberal D.C. officials just got schooled on basic constitutional law, and it’s beautiful to watch. The Oversight Project delivered a devastating legal brief to federal appeals court judges Wednesday, pointing out something so obvious it’s almost embarrassing D.C.’s lawyers missed it: you can’t sue yourself. According to Fox News, the conservative watchdog argued that Washington D.C.’s lawsuit against Trump’s National Guard deployment is fundamentally flawed because the district is part of the federal government.
This isn’t just about one lawsuit. It’s about restoring constitutional order and putting liberal local officials back in their lane. “If the judges find our argument valid, it’s going to kind of restore the normal system, which is D.C. is entirely subordinate to the federal government and these disputes are resolved politically,” Oversight Project lawyer Sam Dewey explained. Translation: D.C. Democrats need to stop forum shopping in federal court and take their complaints to Congress like everyone else.
The whole mess started when D.C. Attorney General Brian Schwalb threw a legal tantrum last September, claiming President Trump violated the city’s independence by deploying National Guard troops to make the capital “safe and beautiful.” But here’s the kicker: two Trump-appointed judges on the appeals panel already signaled they’re not buying D.C.’s victim act, writing that the district doesn’t possess “independent sovereignty” that would give it standing to sue the federal government.
Meanwhile, Trump’s National Guard deployment is working exactly as intended. The President extended roughly 2,600 National Guard soldiers through 2026 and has made it clear he wants them to stay even longer. “I never want to take them out of D.C.,” Trump said during a Cabinet meeting, because unlike D.C.’s failed Democratic leadership, he actually cares about keeping Americans safe in their own capital city.
This case could set a massive precedent that goes far beyond National Guard deployments. If the appeals court rules correctly, it will remind every liberal city and district that they can’t use federal courts as their personal complaint department against lawful federal actions. The constitutional framework is clear: local governments answer to federal authority, not the other way around.
